'Amicable resolution' over Ryall driveway defecation
5:48pm Thursday 14th March 2013 in News
By James Connell
A PENSIONER who had his drive fouled by a binman has reached an 'amicable resolution' with the council concerned.
On Saturday, March 9, we reported how the desperate dustman had fouled a driveway in Ryall, near Upton-upon-Severn, much to the disgust of the homeowner.
The binman, who has since been disciplined by Malvern Hills District Council and removed form the round, admitted the incident - on January 17 - when confronted by his bosses.
Chris Bocock, chief executive of the council, said: "The council has reached an amicable resolution with the resident on the initial complaint about the behaviour of a member of our refuse and recycling team, and other matters of concern, and both parties consider the matter to be closed."

If you can confirm that the gunman paid this fine himself that's great. All is fine. Portmoth 41 could have taken a civil action no debt against said poo man. But either the officers or the gunman should pay compensation.
Not the tax payer. I did not poo on your drive neither do i sanction the way he behaved.

If the accused defecated then his parent had not potty trained him correctly. However, if he urinated on this driveway. It begs the question why they did not request to use the of the property owners toilet.
It must be a very distressing for person who works outside doing a full time job with no public conveniences available.
Why this person fouled someone’s driveway has not been made clear why this employee was placed in this terrible position. Sarah makes a very moot point. Let us hope the compensation is not from the Council Tax Fund.
While others attack, what Sarah and her chickens have said, one thing is! When a senior officer makes a statement “that amicable resolution with the resident” monies will certainly have changed hands. Whose monies one can only guess?

You asked if i had proof of compensation payment and i answered you.
If the officers and the Binman had managed this whole thing better it would have remained private. They didn't and so the drive owner went to the press.
If it is upsetting people then i am afraid that there is only one person to blame and its not me.

If blogs on this subject are to be believed, then this man has urinated twice on this drive and then committed a third offence by not only defecating, but using toilet paper and leaving both in the drive. He could have used a bin bag, but no. He could have cleared it up, but no. Yes it is difficult for employees working where there is not ready access to a toilet, but however desperate you were, would you use someone's drive? Would you be likely to have toilet paper with you? If it was in a place where people might see it or walk into it, would you just leave it when you had had the means to clear it up? This is inexcusable behaviour, yet someone at the top has decided that he should keep his job; that other people must clear up his mess and that, most likely, us council tax payers should pay the compensation. How this can be considered proper, fair and just is beyond me.
I'd rather see council tax going towards paying this chap compensation rather than paying the wages of the filthy individual who used his driveway as a public convenience.

However, I must disagree, with your latest comment re-managing the service. Officers, are paid very good salaries to manage, the refuse disposable officer (Bin Men) are only paid for collecting refuse from its pick up point as laid down by a well-paid officer of the Council. Those in the front line of the service (bin men) are only doing what they are employed to do empty bins.

The council waited until the gazette had gone to print before releasing that a financial settlement had been released.
As Casmal says very well above the Binman should have dealt with his poo better. The officers should have managed the disciplinary better so that it did not end up on the national news and the taxpayer did not end up paying compensation.

I should have read it more carefully.

It is alleged the Gazette has been given a statement by the council after the deadline for this week's paper stating that a financial settlement has been made. THIS IS NOT correct.. The Gazette has NOT received a statement from the council saying there has been a financial settlement - either before or after deadline. The only statement we have received from the council says there has been an 'amicable resolution.' Whether that involves financial compensation we do not know. If we find out we will tell you. Please do not force us to close down the comments because we are being misquoted.

A binman starts work at 7.00am and generally finishes around 3 or 4.00pm.
All that time they are out on the road. When the situation arises just what are they supposed to do when they need to go to the toilet? Many public toilets have, over the years, been closed by local councils.
What this man did, or rather where he did it, is in many people's eyes inexcusable but in some ways understandable.
So, what is the solution? Let's hear from all those who are critical of his actions just what they would do.
Instead of being highly critical how about being constructive and coming up with ideas on how and where binmen can relieve themselves when out on their rounds. Put yourselves in their shoes, think about it.

Well said!!!! I think they should have porter loo like campers have in truck!!! I feel deeply sadden that this has come to all this.... I really feel it needs to stop what is done is done!!! Let this chap move forward and learn from it!!! It's people who think they know it all and are so perfect really are not!!! Make a positive out of a negative!!!!
I would like to correct you on your statement I would not normally do this however, you did criticise another contributor to these columns in relation to Binmen and “Gunmen”.
Therefore, unless you mean that there should be a person employed along with these outdoor operators to carry a toilet. It is a Portaloo not a Porter Loo.

Omicron wrote:Excuse me, in what way could it possibly be understandable. I, like all people I would imagine, have had some kind of urgency problem at some time in their lives. There is no way that I, or the vast majority of people would think of going in someone's drive.
Now that this saga is hopefully coming to an end can anyone offer any sensible suggestions how this could have been prevented and what can be done to prevent it happening again.

And if you had read my blog carefully, you would have seen that I did, in fact, express sympathy for anyone one in this situation. I have worked in situations which pose the same predicament, so I know the problem first hand.
You would also have seen that it wasn't just the fact that he did it, but he had the means of clearing it up, but just didn't bother.
And finally, you would have seen that I did, in fact, include constructive suggestion: first he could have gone in a black sack, and deposited the whole thing in the back of his lorry; second he could have scooped it up with the equipment they have on the lorries and thrown it in the back of the lorry.
And finally, why have we not encountered this type of complaint before? Could it just be that the vast majority of refuse workers, (who do an excellent job in all weathers; the type of job that few of us would choose to do, and are only too grateful to them for), are thoughtful and considerate have managed to find a much more socially acceptable solution to the problem. If they can do it, so can he.

This story is boring me senseless but what I can't seem to shake off is why that drive? Is there some bad feeling between the home owner and the refuse collector disposer officer thingymabob? After urinating twice then doing a big poo I just can't help but wonder.

I hope that the council met the demands by the pensioner for £1500 compensation and did not succeed in fobbing him off.
