A DRUNK swore and shouted at police - and then refused to accept a fixed penalty notice because he wanted to tell "his side of the story" in court.

Nicolas Martinez then refused to accept a fixed penalty notice from officers, Worcester Magistrates Court was told.

Nicolas Martinez, of Broadmeadow, Chawson, Droitwich, admitted a charge of being drunk and disorderly in a public place when he appeared at the court on Thursday, January 5.

Roger Bleazard, prosecuting, said Martinez came to the attention of police in St Swithins Street, Worcester, at about 12.10am on December 18.

After shouting and swearing at officers, Mr Bleazard said Martinez was told to stop.

But Martinez then continued sharing his political opinions, telling officers they should let people speak.

Mr Bleazard said had the 30-year-old took the advice of officers and stopped, and then accepted a fixed penalty notice, he would have been allowed to go on his way and would not have had to go to court.

Defending himself, Martinez said that although he accepted the charge against him, he was not happy with the way officers had handled the situation.

He said police had initially arrested one of the group he was with "for their phone", which he did not think was right, and added officers had then had him "pinned up against a window".

Martinez said that accepting the fixed penalty notice would had meant no court appearance and not allowed him to put his side forward.

"Nobody was hearing my side of the story," Martinez said.

"I agree what I did was wrong."

Martinez was fined £60, and ordered to pay costs of £85 and a victim surcharge of £30 – a total of £175.
