AN angry man assaulted his ex when they rowed because he had got another woman pregnant.

Damien Smith of Ivy Lane, Breforton, near Evesham pushed his ex Beth King against a sink and threw her to the ground during the attack.

The 26-year-old admitted assault by beating when he appeared before magistrates in Worcester on Wednesday following the assault on February 25. Smith disputed claims that he had also kicked her which was accepted by the court following an earlier hearing.

Dawn Foxall, prosecuting, said: "The complainant is the ex-partner of the defendant. She described that, on February 24, the relationship had started to deteriorate with allegations of infidelity and Mr Smith getting another female pregnant. This has been a bone of contention."

Matters came to a head after the ex met the other woman in a store in Evesham which she said caused Smith to fly into 'a fit of rage' and to smash a set of Royal Doluton dolls before he grabbed her and pushed her up against the sink and threw her to the living room floor.

It was then he told her: "I swear on my nan and granddad if you call the gavvers (a Romany word for police officers) I'll drive through your front window!"

Smith, who represented himself, said: "Sorry. I never wanted to be in this place. I feel I have betrayed my nan who looked after me for six years."

The court heard that Smith had no previous convictions at all. Magistrates made a community order for 30 months to include 30 rehabilitation activity requirement days and 70 hours of unpaid work. He must pay £135 costs, compensation to the victim of £220 and a £90 victim surcharge.

Magistrates also made a restraining order for two years which prohibits Smith from communicating with the victim either directly or indirectly except via an approved third party. He must not go within 100 metres of Brick Kiln Street in Evesham or within 100 metres of any property she is known to be visiting or where she is working.
