A WORCESTER man who punched his uncle several times in the face has been warned he can expect to be jailed if he commits another offence in the next two years.

Ashleigh Booth was sentenced for his role in a vicious attack,

Jas Dhaliwal, prosecuting, at Worcester Crown Court, explained there had been “friction” between Booth and a member of his family on January 28 this year.

In the early hours of the following morning the 29-year-old had then gone to the Evesham home of his uncle Tony Gurney.

But Mr Dhaliwal said on arrival the victim told Booth and the others with him they were not allowed inside the home.

“He (Mr Gurney) put his arm across the doorway,” the prosecutor said.

“The defendant then punched Mr Gurney in the face, five or six times.”

The prosecutor said the victim had at first thought Booth was wearing a knuckleduster, but it later emerged Booth was wearing a ring on his finger.

After the victim fell to the floor and was further injured by others with Booth, the victim’s brother then intervened pushing the offenders out of the property and locking it before police were called.

The prosecutor added an aggravating feature was Booth’s seven previous convictions, including being jailed for common assault in 2016.

Jason Patel, defending, said Booth, a labourer currently out of work, had pleaded guilty to one count of assault occasioning actual bodily harm, which had prevented a trial.

He said Booth had not travelled to the victim’s home intending to cause trouble, but instead to return items belonging to his mother who was at the address.

Mr Patel said the dad-of-one, who is expecting another child, accepted his role in causing some of the injuries adding the defendant was now the full time carer for his mother who is dying of cancer.

Sentencing him Judge Martin Jackson said after refusing to be let in the victim’s home Booth had lost his temper, punching the victim several times.

“This caused bleeding to the eyes, bleeding to the nose, and a cut above the eye that required stitching,” the judge said.

The judge said what happened had made the victim feel unsafe in his own home.

He gave Booth a 12 month jail sentence, suspended for two years, placed him on a four month curfew, and ordered him to complete 20 rehabiliation activity days.

Booth, of Derby Road, Worcester and previously of Evesham, was also ordered to pay compensation to his uncle of £500, and court costs of £250.
